Having a roof over your head is one of the most basic human needs. It provides shelter from the extreme weather and the outdoors, helping to keep you safe and healthy. A secure place to live also offers protection from danger, privacy, and peace of mind. Beyond physical protection, having a home provides stability. It allows people to rest, care for themselves and their families, and focus on work, education, and personal goals. A stable home can reduce stress and support better physical and mental well-being. A roof over your head is also a place where relationships grow. It is where families and friends come together to share meals, celebrate special occasions, and create lasting memories. It fosters a sense of belonging and security. In short, having a roof over your head is about much more than shelter. It is the foundation to build a better future. Ultimately, the importance of a home lies not just in the building itself but in the stability, safety, and opportunities it can provide.
At the 2026 New Jersey Planning and Redevelopment Conference (NJPRC), cohosted by New Jersey Future (NJF) and the New Jersey Chapter of the American Planning Association (APANJ), the panel, “Housing as a Human Right: Reframing New Jersey’s Housing Landscape,” explored the implications of recognizing a right to housing in the New Jersey State Constitution and highlighted the importance of doing so.
The panel brought a broad range of perspectives to the discussion, and an even greater depth of firsthand experience. Panelists included: moderator Taiisa Kelly, Chief Executive Officer, Monarch Housing Associates; Katie Brennan, Assemblywoman, State of New Jersey; Beverly Brown Ruggia, Financial Justice Program Director, New Jersey Citizen Action; and John Butler, Political Director, ACLU of New Jersey.
While kicking off the session, Taiisa Kelly introduced the Housing as a Human Right Campaign and highlighted its guiding principles. The campaign is rooted in three pillars, all of which can be addressed through the right to housing: access, stability, and production. The access pillar focuses on addressing mechanisms that hinder people from obtaining adequate housing. Its goals are to end homelessness and eliminate the barriers limiting housing opportunities for many. The stability pillar prioritizes solutions that allow residents to stay in their homes without fear of displacement. To do so, the campaign aims to prevent homelessness by improving eviction protections, empowering tenants to know their rights, enforcing residential living standards to ensure health and safety, and regulating housing market prices to prevent gentrification. The production pillar elevates the need for a more robust, diversified supply of new housing. To improve housing production, the campaign advocates optimizing financing programs to accelerate development, reforming zoning to diversify supply, and increasing support for emerging developers to bring new perspectives to the table.
Assemblywoman Katie Brennan emphasized that housing was one of the main reasons she decided to run for office, describing it as the foundation for people’s safety, health, and access to essential opportunities and services. She noted that Jersey City, where the Assemblywoman represents and resides, accounts for approximately 20% of New Jersey’s housing production, highlighting the city’s significant role in addressing the state’s housing needs. Brennan also discussed several policy solutions, including passing a Homeless Bill of Rights with meaningful enforcement, withholding local aid from municipalities that criminalize homelessness, implementing broker fees, expanding rent control, and guaranteeing tenants the right to legal counsel. She argued that rent control should be centralized at the state level rather than being managed town by town to create a more consistent and equitable housing system. On the local level, the Assemblywoman stressed that officials must not only pass housing policies but also ensure that residents know about them and that they are properly enforced.
Beverly Brown Ruggia emphasized that stable housing is essential for people to live well and pursue happiness, arguing that society must prioritize basic needs such as having a safe place to call home. She summarized this idea with the phrase, “It all starts at the hearth,” highlighting the home as the foundation for individual and community well-being. Ruggia also criticized the commodification of housing, arguing that treating it primarily as a commodity has undermined people’s right to adequate housing while imposing broader social and economic costs on society. She contended that recognizing housing as a human right is a necessary step toward reversing the commodification of housing and ensuring that everyone has access to a safe and stable place to live.
John Butler framed housing as a civil rights and civil liberties issue, arguing that access to housing is a fundamental right that enables people to exercise many other rights and opportunities. He explained that stable housing serves as the foundation for addressing other challenges, noting that individuals struggling with substance use disorders or those returning to society after incarceration often need secure housing before they can effectively pursue treatment, employment, or other forms of support. Butler also contrasted the concepts of positive and negative rights, suggesting that a stronger housing framework should recognize housing as a positive right, one that requires proactive measures to ensure access, rather than relying on the current system, which places fewer obligations on the government to guarantee housing.
Treating housing as a human right matters because housing affects far more than where someone sleeps. It influences health, safety, education, employment, and participation in society. The idea is that every person should have access to safe, secure, and adequate housing, not necessarily ownership of a home or housing provided free of charge. Whether housing is viewed as a human right is both a moral and legislative question. Many countries and international agreements recognize a right to adequate housing, but governments differ significantly in how, or to what extent, they translate that principle into laws, housing programs, and market regulations.
